For the purpose of the Data Protection Act 1998 (DPA), the data controllers are the Chartered Institute of Management Accountants (CIMA) of The Helicon, One South Place, London, EC2M 2RB, United Kingdom and the American Institute of Certified Public Accountants (AICPA) of 220 Leigh Farm Rd., Durham, North Carolina 27707. The Privacy Policy describes how the site administrator collects, uses and shares personal data that you provide via the use of the Site in accordance and in compliance with relevant legislation i.e. DPA 1998 and other relevant European legislations. The Site may contain links to other sites such as CGMA.org, AICPA.org, CPA.com or cimaglobal.com. It is recommended that you check the Privacy Policies which pertain to these sites.

As a user, it is required that you review and accept this Privacy Policy. You also should review the Site Terms and Conditions. By accessing and using the Site, you accept, without limitation or qualification, the Privacy Policy and Terms and Conditions, and agree to be bound by them. With the Site constantly evolving, the Privacy Policy and Terms and Conditions may also change. COLLECTION OF PERSONAL DATA

In order to provide the services offered within this Site, we will collect and process your personal data such as, but not limited to, your first and last name, email address, contact ID, country. In addition, we will store and process any other personal biographical information which you may choose to upload to site from time to time . This information is captured to allow users to log in and view their profile information and to assist users in tracking/managing their continuing professional development/education and to undertake statistical analysis for example demographic reviews, etc. User data is stored within the Amazon Web Services (AWS) infrastructure located in the United States. By providing personal information on the Site, you are transferring your personal data to the United States, and you consent to the transfer to, retention of and processing of your data in the United States.

In order to log in to the Competency and Learning site, AICPA.org or cimaglobal.com credentials are required for authentication. Personal information from your AICPA or CIMA account will feed directly into your account profile on the Competency and Learning site once you have authenticated using your AICPA or CIMA credentials. Once logged into the Competency and Learning site using your credentials, you will have the opportunity to add additional personal information or update existing personal information. For users authenticating using AICPA credentials, updates and additions made to personal information within the Competency and Learning site may feed back to your account on AICPA.org. For users authenticating using CIMA credentials, updates and additions made to personal information within the Competency and Learning site will not feed back to your MyCima account on cimaglobal.com.

ONLINE COMMENTING FEATURES

By participating in functions such as, but not limited to, posting a comment, reviewing or participating in a discussion forum, blog, wiki or similar activity, be advised that personal information within your profile may be viewable by site visitors when using these functionalities. This includes information such as, but not limited to, your name, company name, biography, job title and resume. If your contact information is included within your resume or biography, this may result in unsolicited communication from other users of the site which are beyond our control.

COLLECTION OF INFORMATION THROUGH COOKIE USE

We may obtain information about your general internet usage by using a “cookie” file. A cookie is an element of data that a website can send to your browser, which may then be stored on your hard drive. If you do not agree, then you can choose to not receive a cookie file by enabling your web browser to refuse cookies or to prompt you before you accept a cookie. We use cookies to 1) record user preferences and allow us to provide a more personalized experience for the Site user including but not limited to displaying news and resources based on previous viewed choices, and 2) track your Site usage (including website usage, referring/exit pages, platform type, date/time stamp, number of clicks, advertisement viewing).

We partner with a third party web analytics company, Google, who may place or recognize a unique cookie on your browser in order to gather statistics regarding website usage and trends. USE OF, SHARING AND DISCLOSURE TO THIRD PARTIES

We use collected information to build quality and useful services and user interactions by analyzing user trends and by measuring demographics and interests. We use information to provide you with prompt and effective services. In doing so, your personal data may be controlled and processed by any of our other offices or to our affiliates, agents or appointed representatives which / who may be based outside of EEA. We may use anonymized data in the aggregate (such as interest area information) and disclose to third parties such as our third party developer, Bridge2Think to assist in developing new features and content, as well as information on trends and usage patterns. No personal data will be used other than for the purpose for which it was originally obtained.

Please note that selected third parties may require access to your personal data where such third parties provide services to us, for example, website hosting services. In those circumstances those third parties shall be required to enter into an agreement with us containing terms no less stringent than found in this policy and to process your personal data solely in accordance with our instructions. You consent to your personal data being provided to such third parties for these purposes.

If you consent, we may use your email address to contact you by email to provide you with further information about us, our products/services and to promote our Site. This may involve disclosing your personal data to our other offices or to our affiliates, agents or appointed representatives.

Other types of disclosures may be made without asking for explicit consent from you. These include, but are not limited to, disclosures with regard to subpoenas, warrants or other related legal requests or proceedings as permitted by or required by law.

CHOICE AND OPT-OUT

Additionally, any Newsletter or subscriptions will include an option to unsubscribe.

PARENTS AND CHILDREN

We strive to comply with the provisions of COPPA (The Children’s Online Privacy Protection Act) and do not knowingly collect personally identifiable information from children under 13. SECURITY AND OTHER

We use reasonable measures to strive to safeguard and secure the personal data we collect. Any transmission of personal information is at your own risk. Technology, such as, but not limited to, Transport Layer Security (TLS) and Secured Socket Layer (SSL), is used to enhance security and reduce risk of loss. Our security practices, processes or technology do not guarantee absolute security of your information and you should take all normal personal precautions such as, but not limited to, not sharing passwords, closing browsers, and not using public networks (e.g., internet cafes, etc.).
